Article 1 – Our commercial policy

The company TC RETAIL offers products for sale on these general conditions expressing the entirety of the obligations of the parties by governing the sale by Internet of the products on the day of the placing of the order by the Customer. In this sense, the Customer is deemed to accept without reservation all the provisions provided for in these general conditions of sale. For its part, TC RETAIL undertakes to respect its role as a reseller within the framework of these conditions.
These General Conditions of Sale apply to all orders placed with the company TC RETAIL and for theOutfit articles and services offered on the site www.tartine-et-chocolat.com by non-commercial natural persons (hereinafter "the Customer").
Consequently, the fact for any person to order a product offered for sale on the website of Tartine et Chocolat implies full and complete acceptance of these General Terms and Conditions of Sale, which the Customer acknowledges having read prior to his order. The company TC RETAIL reserves the right to modify the general conditions of sale at any time.
 

Article 2 - Buy on our Store online

The order form contains theOutfit essential information for the order, the price of the products (including applicable taxes or taxes), the means of payment and the possible delivery methods as well as the delivery costs.

No cancellation compensation, apart from the full refund of said Order, can be requested except if the non-performance of the contract is attributable to the company TC RETAIL. TC RETAIL cannot be held responsible for the non-performance of the concluded contract if it is attributable to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure.
 

Article 3 - Information on the products

We pay particular attention to the description of the Products on the Site in order to meet the requirements of Article L.111-1 of the Consumer Code. Article 4 - Ordering process

When placing his first order on the Site, the Customer must choose an identifier (consisting of his email address) and a password. The Customer must also fill in a certain number of essential information for the taking into account of the order and its execution.
The computerized registers, kept in the computer systems of the company TC RETAIL under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. At no time does TC RETAIL receive, store, record, transmit some elements of its customers' banking information. All banking information is directly processed by its partners specialize. Article 5 - Prices

The sales prices of the products indicated are expressed in Euros and are inclusive of All Taxes (TTC) but do not include delivery costs, which are the responsibility of the customer and are invoiced in addition to the price of the products.
The selling prices of the products are those in force on the date of sending the validation of the order by the Customer. The delivery costs will be indicated before the final validation of the order by the Customer. The prices also do not take into account any promotional offers and personal discounts, indicated before the final validation of the order. The prices include the Value Added Tax (VAT) applicable on the day of the order and any change in the rate applicable will be automatically reflected on the price of the products sold by the company TC RETAIL on the site www.tartine-et-chocolat.com . Article 6 - Payment

The products are delivered to the address provided by the Customer when ordering. The Customer must verify the completeness and compliance of the information he provides to TC RETAIL. In case of error by the Customer in the delivery address, the package will be returned by the carrier with the mention NPAI ("does not live at the address indicated"). In this case, the delivery costs will remain the responsibility of the Customer.
TC RETAIL cannot be held responsible for delivery delays if these are attributable to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure. Delivery is offered from € 150 of purchase, by Colissimo (excluding furniture) with delivery without signature.  We offer a "new customer" offer with the WELCOME code: free delivery in metropolitan France for your first order exclusively with Relay Global shipping services and Colissimo Access. This offer cannot be combined with any other promotional offer and is not valid on discounted prices and soft prices.
For any order placed online and confirmed on our website, the preparation of the order will take place within 2 working days, within the limits of available stocks. In the case of an order that includes one or more unavailable products, the TC RETAIL company ships only the available products of the order and proceeds to the cancellation and therefore to the refund of the unavailable products. The Customer service will then contact the Customer as soon as possible.
An e-mail will be sent to you at the time of shipment of the products, provided that the e-mail address indicated in the registration form does not contain an error. Upon receipt of this e-mail, you will be able to take into account the deadlines of the carriers announced below.

Colissimo : This delivery method guarantees the presentation of your package within 48 hours for the sum of 6.90 euros, in Metropolitan France and Monaco only, from the shipment thanks to the Post Office and the Colissimo service (excluding processing time and preparation of the order). Deliveries are made from Monday to Saturday morning, except public holidays. The parcel is taken care of by the Post Office and delivered to the delivery address indicated by the Customer. In case of absence of the Customer during the delivery and if the dimensions of the package allow it, the postman will leave the package in the mailbox. Otherwise, a notice of passage will indicate to the Customer where to pick up the package at the nearby post office for 15 days.

Relay Point : This delivery method offers you to be delivered to one of the relay points in France and in some European countries. The preparation and delivery costs at the relay point are 4.90 euros. The average delivery time at a relay point is 5 working days. You will be informed by e-mail of the arrival of your package in relay; you have a period of 10 working days from the date of sending the e-mail to pick up your order, on presentation a valid identity document. At the expiration of the deadline, the package will be considered abandoned and can no longer be the subject of any claim. Chonopost : This delivery method guarantees the shipment of the package within 48 hours for the sum of 9.90 euros, in Metropolitan France and Monaco only, from the shipment thanks to the Chronopost service (excluding processing time and preparation of the order). Deliveries are made from Monday to Saturday, except public holidays. The parcel is taken care of by Chronopost and delivered to the delivery address indicated on the order. Parcel tracking is carried out on the site www.chronopost.fr/suivi with the number of the transport voucher of your package. In case of absence during delivery, an SMS will be sent to you, telling you where to pick up your package in the Parcel Relay or the nearest Chronopost agency within 10 days. In case of non-withdrawal within the deadlines set by the carrier, the products will be returned to the sender. The site www.tartine-et-chocolat.com will reimburse the Customer for the amount of the products ordered on the basis of the invoiced price, excluding delivery costs.

Colissimo International : This delivery method is reserved for European countries and allows you to present your package between 3 to 8 working days from 6.90 euros. Delivery is only from Monday to Friday except public holidays. The package will be delivered against signature. In case of absence during delivery, a notice of passage with the contact details of the carrier will be deposited to agree on a new presentation. Orders may be subject to any taxes and customs fees of the country of destination and will be the responsibility of the customer.

UPS : This delivery method (express delivery) is reserved for the shipment of parcels to European countries with the exception of Cyprus from 12.90 euros. It allows the Customer to present his package within 48 hours. Orders may be subject to any taxes and customs fees of the destination country and will be borne by the customer.

DHL : This delivery method is reserved for the shipment of parcels to the United States, Canada, Switzerland and the United Kingdom. It allows you to present your package between 3 and 5 working days from 12.90 euros. Orders may be subject to any taxes and customs fees of the destination country and will be borne by the customer.

In Store : This delivery method allows to be delivered free of charge in Metropolitan France in one of the Stores participants within 3 to 5 working days.


In the event of a delay in delivery compared to the deadlines announced by the carriers, the company TC RETAIL suggests first of all to the Customer to check with the carrier that the package is not pending, then if necessary to contact Customer Service at + 33 (0) 1 81 69 57 24 ( Price of a call not surcharged) from Monday to Friday, 10 a.m. to 13 p.m. and from 14 p.m. to 18 p.m., excluding public holidays, in order to open a dispute or investigation file to search for the package. The Customer must declare the loss within 30 working days from the date indicated for the delivery of the order. The TC RETAIL company will then take care of making the necessary claims with the carrier concerned. If the package is found, it will be rerouted immediately to the Customer's home. If, at the end of the investigation, the package is not found, the Customer will request a refund of the amount paid.
Our products are packaged in such a way as to comply with current transport standards, and to ensure optimal protection of the products during their delivery. The Customer is asked to respect these same standards when returning a product. Any damage found to a product on return due to a non-respected packaging level problem may result in a partial refund or a non-refund of the product in case of impossibility of resale as is or in case of aggravation of the indicated technical problem.
We remind you that it is the responsibility of the Customer to inspect his packages upon receipt and to notify any anomaly (damage, damage to the package, missing product compared to the delivery note, broken products, delivery date not in accordance with the normal deadlines of the delivery service, reference error ...) to the company TC RETAIL, within 3 working days. Article 8 - Packaging

The packaging option Gift is available online! All you have to do is add the option in your cart before validating your order. The order will thus be carefully packaged by hand in a package Tartine et Chocolat.
You will also have the possibility to attach a card where you can write down a personalized message. Attention: the option cannot be applied to large items (Soft toy 35 cm, deckchair, bassinet, Furniture...) and this option offers a single package Gift by order.


Article 9 –Furniture

It is up to the Customer to specify when making an appointment with the delivery company the accessibility of the carrier. The TC RETAIL company undertakes to honor the delivery of the furniture to the Customer as soon as possible. Delivery times are provided for information purposes only. Exceeding delivery deadlines cannot give rise to damages, a deduction, or the cancellation of the order by the Customer. If the schedule proposed by the carrier does not suit the Customer, the appointment will be postponed to a later date without damages. Likewise, if the delivery could not take place due in particular to, and as an example, of incomplete information by the customer, the latter will bear the cost of a second delivery up to 200 euros. The delivery of the Furniture is offered from € 2,500 of purchase, in Metropolitan France.
Upon delivery, the carrier will present the transport document to the customer in duplicate: A pre-filled copy for the carrier and a copy for the customer. Tartine et Chocolat particularly draws the attention of its customers to the pre-filled areas :
  • The number of packages
  • The condition of the packaging
  • The condition of the product after unpacking by the delivery person
  • The quality of the assembly.
    These four boxes must be checked. In case of disputes, TC RETAIL invites its customers to cross out the mentions already entered and to note its reservations, and this in the presence of the carrier. All reservations must be noted in detail and precisely in the three boxes provided for this purpose and on both copies.
    ATTENTION: When the customer signs the delivery note of the carrier, he acknowledges having received the goods in good condition. Any damage identified later cannot call into question the responsibility of the carrier and be the subject of a claim for compensation. TC RETAIL therefore recommends that its customers wait for the end of the intervention and take the time to check everything before signing the carrier's vouchers. It is specified that for each piece of furniture, the finish can be different, and in particular the color. The shades form part of the identity of the product and are considered normal and acceptable. They do not constitute a valid reason for exchange or refund. After delivery and in the event of a dispute, the customer has a period of 48 working hours to notify customer service Tartine et Chocolat, any apparent non-conformity or any apparent defect of the delivered products. After this period, the products will be declared compliant and free of any defects and any exchange will be the exclusive responsibility of the customer. It is up to the customer to provide in the form of photograph(s) any justification as to the reality of the defects or damage found. The customer will refrain from intervening himself or involving a third party to try to remedy it. In case of non-conformity or apparent defect turned out, the company Tartine et Chocolat undertakes to replace the non-compliant delivery. In no case can any compensation be demanded. The delivery note (waybill) delivered by the carrier, dated and signed by the Customer upon delivery of the products will constitute proof of transport and delivery.
    Eco-Participation : Tartine et Chocolat is registered in the National Register of marketers of furnishing elements under the number FR015403. This number guarantees that Tartine et Chocolat, by joining Eco-Furniture, complies with the regulatory obligations incumbent on it in application of Article L 541-10-1 10 ° of the Environmental Code.


    Article 10 - Right of withdrawal and returns

    In accordance with the provisions of Article L.221-18 of the Consumer Code, the Customer has a period of 14 clear days to return the Product (s) ordered, without having to justify his decision or to bear other costs than those provided for in this article. This period runs from the day after the or the first working day following the day of delivery of the order or the day of delivery of the last product when the order is subject to a staggered delivery in several times.

    For deliveries in metropolitan France, returns are free thanks to the Colissimo Return Voucher available in your customer area.

    Choose the item (s) to be returned, specify the quantity of item (s) returned as well as the reason for the return and validate. An explanatory email is automatically sent to you.

    Print the attachments: insert the return voucher in your package and paste the correct carrier on your package.

    Step 2 :

    Prepare your package and drop it off :

    - In the post office

    - In your mailbox before 8:00 in the morning without forgetting to make a request on www.laposte.fr/retourbal

    If you opt for a post office or a merchant of the La Poste network, do not forget to have the stamp or signature affixed. This proof of deposit will allow you to track the progress of your return.


    For deliveries outside metropolitan France :

    For deliveries outside metropolitan France: returns are at your expense as well as any customs taxes.

    Step 1 :

    Choose the item (s) to be returned, specify the quantity of item (s) returned as well as the reason for the return and validate. An explanatory email is automatically sent to you.

    Print the attachments: insert the return voucher in your package and paste the correct carrier on your package.

    Step 2 :

    Prepare your package and drop it off at a postal center.

    Returns are to be declared in your customer area on the site, in the "Orders" section.
    An e-mail with the return slip will then be sent to you and the return costs will be deducted from your refund.

    Company Tartine et Chocolat informs that no refund can take place before having previously received and checked the conformity of the condition of the item (s) concerned by this request.


    TC RETAIL will refund the Customer no later than 14 days from the date on which it is informed of the Customer's decision to withdraw. Nevertheless, we may postpone the refund until the products are recovered, the date chosen is that of the first of these facts. If the customer wishes to keep this amount in the form of a credit note on his account Tartine et Chocolat in order to use it as a deduction for a future order, he must inform the Customer Service when requesting a return. When an order is placed with a discount voucher, the value of the discount voucher will be deducted from the amount of the credit note or refund in proportion to the amount of the items ordered.
    In the event that there is no correspondence between the recipient of the products indicated in the order form and the one who made the payment of the sums due for the purchase, the refund of the sum, in case of exercise of the right of withdrawal, will be made by TC RETAIL, in any case, to the one who made the payment.
     

    Article 11 - Warranty

    In accordance with article 4 of Decree n ° 78-464 of March 24, 1978, the provisions hereof cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects of the thing sold. This clause is applicable only in the context of a complete payment of the order. The Customer is expressly informed that TC RETAIL is not the producer of the products presented as part of the website www.tartine-et-chocolat.com , within the meaning of law n ° 98-389 of May 19, 1998 and relating to liability for defective products. Consequently, in the event of damage caused to a person or property by a defect in the product, only the responsibility of the producer of the latter may be sought by the Customer, based on the information appearing on the packaging of said product.     In the event of force majeure, neither party (Customer and TC RETAIL) will have failed in its contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous event or force majeure. Fortuitous events or force majeure will be considered all irresistible facts or circumstances, external to the parties, unpredictable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all efforts reasonably possible. The party affected by such circumstances will notify the other within ten working days of the date on which it has become aware of it. The two parties will then get closer, within one month, unless it is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.

    Article 1641 : The seller is bound by the guarantee due to hidden defects in the thing sold that make it unsuitable for the use for which it is intended, or that diminish this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known about them.

    Article 1642 : The seller is not liable for apparent defects and of which the buyer has been able to convince himself.

    Article 1642-1 : The seller of a building to be built cannot be discharged, either before the receipt of the work, or before the expiration of a period of one month after the acquisition of possession by the purchaser, of the construction defects or defects of conformity then apparent.
    There will be no reason to terminate the contract or to reduce the price if the seller undertakes to repair.

    Article 1643 : He is liable for hidden defects, even if he would not have known about them, unless, in this case, he has stipulated that he will not be obliged to any guarantee.

    Article 1644 : In the case of articles 1641 and 1643, the buyer has the choice to return the item and have the price refunded, or to keep the item and have part of the price returned.

    Article 1645 : If the seller knew about the defects of the thing, he is liable, in addition to the refund of the price he received for it, for all damages and interests against the buyer.

    Article 1646 : If the seller was unaware of the defects of the thing, he will only be required to return the price, and to reimburse the buyer for the costs caused by the sale.

    Article 1646-1 : The seller of an immovable to be built is bound, from the reception of the works, by the obligations of which the architects, contractors and other persons linked to the client by a contract of lease of work are themselves bound in application of articles 1792, 1792-1, 1792-2 and 1792-3 of this Code.
    These guarantees benefit the successive owners of the building.
    There will be no reason to cancel the sale or to reduce the price if the seller undertakes to repair the damage defined in articles 1792, 1792-1 and 1792-2 of this Code and to assume the guarantee provided for in article 1792-3.

    Article 1647 : If the thing that had defects perished as a result of its poor quality, the loss is for the seller, who will be liable to the buyer for the refund of the price and the other compensation explained in the two previous articles.
    But the loss arrived by chance will be on behalf of the buyer.

    Article 1648: The action resulting from the redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the defect.
    In the case provided for by Article 1642-1: the action must be brought, on pain of foreclosure, within one year following the date on which the seller can be relieved of apparent defects or lack of conformity.

    Article 1649: It does not take place in sales made by judicial authority.
