This site is operated by the company DIGITAL-STORES.COM, an SAS (French Simplified Joint Stock Company) with share capital of 1,00,000 euros, with headquarters at 6B rue Gabriel Laumain - 75010 Paris (France), listed in the Trade & Companies Register of Paris under number B 533 631 248. These General Terms of Sale apply to all orders placed with the company DIGITAL-STORES.COM for all items and services offered on the site www.tartine-et-chocolat.com by non-commercial individuals (hereafter "the Customer"). Accordingly, any person ordering a product for sale on the Internet site of www.tartine-et-chocolat.com is deemed to have fully accepted these General Terms of Sale, which the customer has read before ordering. DIGITAL-STORES.COM reserves the right to change the terms and conditions of sale at any time.
These general terms state all the obligations of the parties. In this respect, the Customer is deemed to have unreservedly accepted all the provisions in these general terms of sale. DIGITAL-STORES.COM undertakes to fulfil its role of retailer within the framework of the said terms.
Article 2. Purpose
These general terms define the rights and obligations of the parties with regard to the online sale of goods and services offered to the Customer by DIGITAL-STORES.COM, from order to delivery, including payment and use of services provided by the company DIGITAL-STORES.COM.
These general terms govern the sale of products on the day the Customer places an order. They apply to all methods of ordering offered by DIGITAL-STORES.COM, whether the order is placed online or by telephone.
Article 4. Order
The DIGITAL-STORES.COM customer hereby declares he/she has full legal capacity to commit to these general terms of sale.
DIGITAL-STORES.COM reserves the right to cancel and refuse any order from a Customer with whom a dispute is ongoing or arises while the order is being processed, in particular any dispute in connection with the payment of a previous order.
When the customer ticks the box "I have read and accepted the General Terms of Sale" before paying, this stands as irrevocable and incontestable acceptance, which can only be challenged in cases specifically provided for in the paragraph entitled "right of withdrawal". In so doing, the Customer acknowledges having read, understood and accepted these terms and conditions.
A purchase made by telephone also implies acceptance of these Terms, which the Customer acknowledges having read, understood and accepted in the aforementioned conditions.

Ordering is a seven-step process:
Firstly, the Customer must select the product(s) he or she want to buy.
The Customer must then confirm his or her shopping basket.
The Customer must check the colour and size options of the selected products and state the required quantities.
The order can only be registered on the site if the Customer is clearly identified, either by an e-mail address and personal password or by providing all the particular details required for online registration.
Once identified, the Customer must clearly specify their delivery information, in particular the precise delivery address as well as any restrictions to accessibility (building, floor, door code, etc.).
The penultimate step: the Customer must state his or her chosen method of delivery.
Finally, the Customer must state his or her chosen method of payment and make payment in the secure interface, which will be deemed firm and final acceptance of the contract of sale with DIGITAL-STORES.COM.
All orders imply acceptance of the price and description of products on sale. Any dispute in this respect will be the subject of a possible exchange and the guarantees mentioned below. Online entry of the bank card number on the form of one of our payment partners and final confirmation of the order by the Customer will be deemed proof of ordering and of payment due for the ordered products.
An e-mail message is automatically sent to the Customer to confirm the order, provided there are no errors in the e-mail address stated on the registration form.

The computerised records, kept in DIGITAL-STORES.COM's computer systems in conditions of reasonable security, will be deemed proof of communication, orders and payments between the parties. DIGITAL-STORES.COM never receives, stores, records or transmits its Customers’ banking particulars.
All banking details order are processed directly by its specialised partner (Société Générale, PayPal).Purchase orders and invoices are archived on reliable and durable storage media that can be produced as evidence.
In accordance with article L. 111-1 of the consumer code, Customers may, prior to ordering, inform themselves of essential characteristics of the product(s) they wish to order on the www.tartine-et-chocolat.com website. Customers can select one or more products among the different categories offered on www.tartine-et-chocolat.com.
The information, specifications, photographs and graphics presented on the www.tartine-et-chocolat.com website or in e-mail messages sent by DIGITAL-STORES.COM are only indicative and are mostly provided by the suppliers. Consequently, DIGITAL-STORES.COM cannot be held liable for any difference in perception of shapes and colours between the photographs or graphics presented and the actual products.
DIGITAL-STORES.COM endeavours to ensure that the photographic representation of the products on www.tartine-et-chocolat.com is as faithful as possible. However, the perception of the product or products may not fully match the products.
DIGITAL-STORES.COM will assume no liability for any consequential damage arising from these terms, more particularly including business interruption, loss of profits, loss of opportunity, damages or expenses that may arise as a result of purchasing the products. DIGITAL-STORES.COM cannot be responsible for any loss of data, files or any damage defined in the previous paragraph.
DIGITAL-STORES.COM only undertakes to honour orders received while stocks last. If the product(s) is/are out of stock, DIGITAL-STORES.COM undertakes to inform the Customer thereof as soon as possible.
DIGITAL-STORES.COM may change the product mix offered for sale on its www.tartine-et-chocolat.com site.
Availability may vary on the same day according to the volume of sales. DIGITAL-STORES.COM updates its stock availability very often, but cannot be held liable if the stock level is no longer the same as the one shown.
If the company DIGITAL-STORES.COM is unable to obtain an ordered product from its suppliers, it will inform the Customer of the anticipated delay or of the unavailability of the product by email or by telephone. The Customer can request to exchange the unavailable product or be reimbursed within a maximum of thirty days.
No compensation for cancellation may be claimed, apart from a full or partial refund of the said order, unless non-fulfilment of the contract is attributable to DIGITAL-STORES.COM.
DIGITAL-STORES.COM cannot be held liable for non-fulfilment of the contract if this is attributable to an unforeseeable and insurmountable factor of a third party to the contract or to a case of force majeure.
Article 6. Price
The selling price of listed products is stated in euros and includes all taxes. The prices are those in force on the date the Customer sends confirmation of his order.
Prices may be changed by DIGITAL-STORES.COM at any time.
Prices do not include the delivery cost, which is payable by and charged to the Customer on top of the price of products purchased, according to the amount of the order. Delivery charges are indicated before the Customer's final confirmation of the order. The prices do not reflect any promotional offers and personal discounts, which are also indicated before final confirmation of the order.
Prices include Value Added Tax applicable on the day of the order and any change in the applicable rate will be automatically reflected in the price of products sold by DIGITAL-STORES.COM on the site www.tartine-et-chocolat.com.
However, prices cannot be modified once the Customer has placed the order. In addition, if any taxes or contributions, environmental contributions in particular, were to be introduced or adjusted upwards or downwards, this will be reflected on the selling price of products sold by DIGITAL-STORES.COM on www.tartine-et-chocolat.com.
Article 7. Payment
Full payment is required when the Customer places the order. At no time will any sums paid be considered deposits or down payments.
Customers can pay for their orders by PayPal and bank card: Carte Bleue (Debit card), Visa, Eurocard and MasterCard or PayPal. Customers must enter the card number on the front of the card, the card's expiry date and the security code on the back of the card (3 digits).
When confirming their orders, Customers guarantee DIGITAL-STORES.COM that they have the necessary permission to use their chosen means of payment.
DIGITAL-STORES.COM reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum owed by the Customer, in the event of an ongoing payment dispute, in the event of a payment incident, or in case of fraud or attempted fraud relating to the use of the www.tartine-et-chocolat.com site.
DIGITAL-STORES.COM reserves the right to ask the Customer for supporting documents prior to confirming an order. As part of its order checking procedure, DIGITAL-STORES.COM may ask the Customer to send a set of supporting documents by e-mail, post or fax. In such cases the order will only be confirmed after receipt and verification of said documents. If they are not received within 15 days of the order, the latter will be deemed cancelled by rights.
Customers can make their purchases with complete peace of mind; DIGITAL-STORES.COM undertakes to make every effort to ensure the security and confidentiality of all data transmitted online, including banking information, via its payment partners. The site uses SSL (Secure Socket Layer), a secure payment method that encrypts bank details when transmitted over the network. Customers can see that the transmission is encrypted by software when the padlock symbol appears in their browser. The transaction is handled by Société Générale or PayPal, the only parties with the banking particulars on the site at the time of payment.
The Customer has the original invoice, in the "My account" section of the www.tartine-et-chocolat.com site.
DIGITAL-STORES.COM retains full ownership of the products it sells until it receives full payment of the price, including mandatory costs, taxes and contributions.
DIGITAL-STORES.COM delivers within the following countries of the European Union: France, Germany, Luxembourg, the Netherlands, Belgium, Spain (excluding the Balearic Islands), Italy, United Kingdom, Austria, Hungary, Portugal, Bulgaria, Estonia, Finland, Greece, Latvia , Lithuania, Czech Republic, Slovakia, Slovenia and Sweden (except particular areas imposing duty-free sales such as DOM/TOM), For further questions regarding delivery, please call DIGITAL-STORES.COM Customer Service on 0033 352 52 62 13 (price of a standard charge call) from Monday to Friday (excluding public holidays) from 9 a.m. to 6 p.m.
Products are delivered to the address stated by the Customer on the order form. Customers are required to verify the completeness and conformity of the information they provide to DIGITAL-STORES.COM. DIGITAL-STORES.COM cannot be held responsible for any typing errors and the consequences thereof in terms of delay or error in delivery. In this respect, all costs incurred to re-dispatch the order will be fully charged to the customer.
DIGITAL-STORES.COM cannot be held liable for non-fulfilment of the contract if this is attributable to an unforeseeable and insurmountable factor of a third party to the contract or to a case of force majeure.
- Colissimo (no signature required)
This delivery method allows the Customer to receive his package within 48 hours at a cost of 6.90 euros, within Metropolitan France, using the Post Office and the Colissimo service (excluding processing time and order preparation). Deliveries are made between Monday and Saturday morning, except public holidays. The package will be delivered by the Post Office to the address indicated by the Customer. If you are absent at the time of delivery and if the dimensions of your package allow it, the postman will post your package through your letter box. Otherwise, you will find a notice inviting you to collect your package from your Post Office within 15 days.
- Mondial Relay
This delivery method allows you to collect your item from one of the 3800 locations of the Mondial Relay network located in Metropolitan France and Belgium. With the convenience of being close to your home, your office, and often open at midday, later in the evening…by choosing this delivery method, the Customer accepts Mondial Relay’s general terms and conditions. The costs for preparation and delivery are 4.90 euros. The average lead time is 5 working days. The Customer will be informed by email of the arrival of his package at the “click and collect” store. A maximum of 10 working days from sending the email will be given to collect your order, whereby a current form of identification must be presented. At the end of this period, the package will be considered as being abandoned and can no longer be collected by the Customer. The site www.tartine-et-chocolat.com will reimburse the Customer for the amount of products ordered based on the invoice price excluding delivery costs.
- TNT Express
This delivery method allows the customer to receive his package within 48 hours at a cost of 9,90 euros, within Metropolitan France and Monaco, (excluding processing time and order preparation). Deliveries are made between Monday and Saturday, except public holidays. The package will be delivered by the Post Office to the address indicated by the Customer.
If the customer is absent at the time of delivery, a text message is sent to him indicate where the package could be pick up (Mondial Relay). After 8 days, the package will be considered as being abandoned and can no longer be collected by the Customer.
- Colissimo International
This delivery method is exclusively for the following European countries: Germany, Luxembourg, the Netherlands, Belgium, Spain, Italy, United Kingdom, Austria, Hungary, Portugal, Bulgaria, Estonia, Finland, Greece, Latvia, Lithuania, Czech Republic, Slovakia, Slovenia and Sweden.
It allows customers to receive a package within 3 to 8 working days at a cost of 6.90 euros. The cost of this option depends on the weight and total volume of the articles ordered. Delivery is made from Monday to Friday only, except public holidays. The package must be signed for on receipt. In case of absence, a non-delivery notice with UPS numbers will be delivered, so that a new delivery can be arranged.
All orders placed online via the site www.tartine-et-chocolat.com and confirmed on this site will be prepared within two business days, within the limits of available stocks.
An e-mail message confirming the order is automatically sent to the Customer, provided there are no errors in the e-mail address stated on the registration form. On receipt of the e-mail, the Customer should bear in mind the delivery times of carriers announced below.
Delivery time is as follows:
Colissimo : 2 (working) days for Metropolitan France
Mondial Relay: The average lead time is 5 working days
- Colissimo international: Depending on the country: from 3to 8 working days.
The aforesaid delivery times are those generally observed. If the delivery is more than 7 days after the delivery date indicated on the website, according to the mode of transport chosen at the time of ordering and except in cases of force majeure, the Customer may demand a cancellation and reimbursement of the order and will be reimbursed within a period of 30 days.
Furthermore, DIGITAL-STORES.COM informs its customers that these delivery times do not include Sundays or public holidays. In the case of an order which includes one or more items that are unavailable as well as one or more items that are available, Digital Stores will only ship the items in the order which are available and will cancel and therefore reimburse the items which are unavailable. The office will therefore contact the Customer as soon as possible.
The products are packaged in a manner that meets current standards of transport and that ensures optimal protection of the goods in transit. The Customer is asked to comply with these same standards when returning items. Any observed damage to a returned product due to a packaging problem may be grounds for a partial refund or non-refund for the item if it cannot be resold as is or if the said technical problem is aggravated.
- Gift wrapping
For that special occasion such as a birth or a birthday, we suggest that you send your order to your chosen recipient in a beautiful gift box matching the Tartine et Chocolat colours and which is accompanied by a message. The items are carefully folded in tissue paper that is scented with Tartine et Chocolat's Ptisenbon fragrance. The personal message will be printed on a small Tartine et Chocolat gift card. When placing your order, tick the box "I would like my items gift wrapped" on the shopping cart page. Unfortunately, it is not possible to gift wrap large items (mobiles, baby chairs, bassinets, furniture, and so on). This option offers one gift wrap per order. This service is not offered when your order only includes promotional items.
DIGITAL-STORES.COM reminds you that it is the Customer's responsibility to inspect parcels on receipt in the presence of the delivery man and to note down any problems on the carrier's delivery note (damage, damage to the package, any missing items listed on the delivery note, broken items, date of delivery beyond normal delivery time, etc.), and to also notify DIGITAL-STORES.COM within 3 working days. If no such observations are noted on the delivery note presented to the Customer by the carrier, the product is deemed to have been accepted by the Customer and cannot be subject of any dispute concerning its delivery.
- Delivery delays linked to the carrier
In the event of a delivery delay regarding the lead times indicated by the carriers, Digital Stores suggests that the Customer checks with the carrier in the first instance that the parcel is not pending; then if necessary, he or she is to contact Customer Services on +33 352 52 62 13 from Monday to Friday, except on bank holidays, from 9am to 6pm,prior to raising a claim or investigation to track the parcel. The Customer is required to declare the loss within 60 working days from the date indicated for the delivery of the order. The company, Digital Stores, will then make the necessary claims with the carrier involved. If the parcel is located, it must be immediately redirected to the Customer's address. If, during a deadline of seven working days and except cases of force majeure, the parcel is not tracked down, the Customer may request that the same item is resent at the expense of Digital Stores or be reimbursed for the amount paid. If the item(s) ordered were no longer available at that time, Digital Stores will reimburse the Customer the value of the items that were attributed to the loss by the carrier.
Article 9. Right of withdrawal, return and refunds
In the context of home shopping (in the absence of simultaneous physical presence of the parties) and in accordance with Article L-121-20 of the French Consumer Code, the Customer has a period of fourteen clear days to exercise his withdrawal right without having to pay penalties, unless there were return charges which remain at the Customer's expense for deliveries outside metropolitan France. This period is measured from the day the Customer receives the items. All returns requests, as well as any return parcel received after this deadline, will not be taken into consideration.
- Digital Stores recommends that the Customer returns his or her items in a parcel by registered delivery or with insurance for the commercial value of the items, guaranteeing the compensation for the items matching their real commercial value in the event of damage or loss of goods. In all cases, the return is made at the Customer's risk. Furthermore, the Customer is advised to retain the proof of return.
Furthermore, Digital Stores reminds the Customer that no exchange or reimbursement can be made prior to receiving and checking the condition of the item(s) concerned with this request (see the conditions outlined below).
- Condition of Products
Returned products must be returned in their original condition and in their entirety (product label, accessories, pouch, etc.). The products must be intact, in perfect condition for resale and in a state of perfect cleanliness; they must not have been worn or used or suffered any deterioration. No damaged or incomplete products will be refunded.
· Refunds for returns
If the Customer chooses to exercise the right of withdrawal and following his choice made at the time of requesting a return, the Customer will receive a refund for the amount paid on his credit card or will receive a credit for his next purchase. The reimbursement of the amount paid is refunded to the credit card that was initially used to pay for the order.
The return shipping costs must be paid by the Customer, except where a delivery error due to DIGITAL-STORES.COM has occurred or a defective item has been received. Should either of these things be the case, the company DIGITAL-STORES.COM will refund the return shipping costs by cheque. The Customer must attach their return shipping cost payment receipt to their package, or send it by email to the address email@example.com or by fax to 0033 352 52 62 13, quoting their order number.
The company DIGITAL-STORES.COM will refund the Customer no later than 14 days counting from the date on which the Customer notifies their decision to cancel the order. However, the company DIGITAL-STORES.COM may postpone payment of the refund until such a time as the returned product has been received back or the Customer has provided proof that the product has been dispatched. The date of the first of these to occur will apply.
If the Customer chooses to keep the amount in the form of a credit on his Tartine et Chocolat account to redeem against a future order, the credit will be generated automatically and will be valid for 1 year starting from the date of issue. It will be available when validating the next order and only on the www.tartine-et-chocolat.com website.
Once an order is placed using a discount voucher, the value of the discount voucher will be deducted from the amount of the credit or the reimbursement proportionally to the amount of the items ordered.
The initial shipping costs of your order are only reimbursed if you return your entire order.
Article 10. Guarantees
In accordance with article 4 of decree No. 78-464 of March 24 1978, the provisions of these terms give the Customer the legal warranty that obliges the retailer to guarantee against all the consequences of hidden defects in the sold item. This clause is only applicable if full payment of the order has been made.
The Customer is expressly informed that DIGITAL-STORES.COM is not the producer of goods shown on www.tartine-et-chocolat.com website, pursuant to law no. 98-389 of 19 May 1998 on liability for defective products.
Accordingly, in the event of damage caused to a person or to property by a defect in the product, the producer's liability alone may be sought by the Customer, on the basis of the details stated on the packaging of the said product. In addition, the products, services and information offered by DIGITAL-STORES.COM are in no way a substitute for the constant vigilance by all adults.
The liability of DIGITAL-STORES.COM cannot be incurred in the event of non-compliance with the laws of the country where the products are delivered. It is the customer's responsibility to check with the local authorities of the possibilities of importation or use of the products or services that you plan to order.
Article 11. Liability
The products on offer comply with current French legislation and meet applicable standards in France. DIGITAL-STORES.COM's liability cannot be incurred in the event of non-compliance with the laws of the country where the products are delivered. It is the customer's responsibility to check with the local authorities of the possibilities of importation or use of the products or services that you plan to order.
The liability of DIGITAL-STORES.COM cannot be incurred for any inconvenience or damage caused by use of the Internet, including an interruption of service, the presence of computer viruses, or external intrusions and more generally any cases qualified by the courts as force majeure or acts of third parties.
Hyperlinks may link to sites other than the www.tartine-et-chocolat.com site. DIGITAL-STORES.COM assumes no liability if the content of such sites contravenes current statutory provisions and regulations.
DIGITAL-STORES.COM will not be liable for any indirect damage arising from the purchase of the products. Similarly, DIGITAL-STORES.COM's liability under these General Terms of Sale shall not be incurred in case of an event of force majeure as defined by the French courts.
Neither party will be deemed in breach of its contractual obligations if due performance thereof is delayed, hindered or prevented by an accidental occurrence or case of force majeure.
By force majeure is meant any external, unpredictable, unavoidable or unforeseen contingencies or circumstances beyond the control of the parties and that they cannot prevent, despite all their reasonable efforts.
The party affected by such circumstances shall notify the other party within ten business days of learning about the said circumstances.
The two parties shall then meet within one month (unless the case of force majeure prevents them from so doing) to examine the impact of the event and agree on the conditions under which the contract can continue.
In accordance with the law known as Informatique et Libertés no. 78-17 of 6 January 1978, as subsequently amended, customers of, visitors to and recipients of orders placed on the www.tartine-et-chocolat.com site have the permanent right to access, modify, rectify and delete any of their personal data processed by the DIGITAL-STORES.COM, as well as the right to object to such data being used for direct marketing purposes. By default, these rights may be exercised by contacting Customer Services.
Any personal data which DIGITAL-STORES.COM collects with any Customer order is needed for it and for its service providers to handle the order and, subject to the rights exercised by the person concerned, may be used to inform the latter of the products or services provided by the said company and/or by its trading partners.
When the Customer registers or places an order, or as part of other special campaigns, DIGITAL-STORES.COM gives the customer or visitor the option of being informed of www.tartine-et-chocolat.com offers by e-mail (newsletters, e-mails on special events and promotional offers).
If customers or visitors do not wish to receive such messages, they can at any time remove this option in their personal account in the "My account" section www.tartine-et-chocolat.com, or notify Customer Services, or can use the unsubscribe link at the bottom of each e-mail sent.
Through DIGITAL-STORES.COM, customers or visitors who have expressly given their prior consent may receive e-mails announcing offers of products or services provided by DIGITAL-STORES.COM's trading partners. Customers or visitors can also change this option at any time.
DIGITAL-STORES.COM uses data collection systems such as cookies. A cookie is a computer file stored on the user's hard disk. Cookies are used to indicate a previous visit of the Customer or Visitor to the site and to link the User to personal data left on site, in particular to help identify the person's shopping basket.
DIGITAL-STORES.COM hereby informs its Customers that the processing of such named and/or personal information has been the subject of a declaration to the CNIL under no 546524v0 on 22/11/2011.

In this respect and in accordance with the provisions of the Intellectual Property Code, only private use is permitted, subject to different or even more restrictive provisions of the intellectual property code.
The User accordingly undertakes not to reproduce, summarise, modify, alter or rebroadcast, without DIGITAL-STORES.COM's express and prior consent, any text, title, application, software, logo, trademark, information or illustration, for any purpose other than strictly private use, which excludes any representation for professional purposes or bulk distribution. Similarly, the User undertakes to not copy any part of the site on another site or an internal corporate network.
Any other use constitutes an infringement sanctioned by the Code of Intellectual Property, barring DIGITAL-STORES.COM's prior consent. Any total or partial reproduction of DIGITAL-STORES.COM's catalogue is strictly prohibited.
Any hypertext link from an Internet site to the www.tartine-et-chocolat.com site is subject to DIGITAL-STORES.COM's express consent. Any such link must be removed at DIGITAL-STORES.COM's request.
No changes in legislation, regulations or a court decision rendering any of these General Terms of Sale null and void can invalidate these General Terms of Sale. Such changes can on no account permit the customer to not comply with these General Terms of Sale.
